  1. Serve 30 consecutive days in jail
    • If the defendant successfully installs and maintains a certified ignition interlock device in their vehicle with 12 months, 21 days may be taken off the jail time sentence
  2. Pay a $250 fine including surcharges
  3. DUI assessment fee of $250
  4. State Prison Construction assessment fee of $1,000
  5. State General Fund assessment fee of $1,000
  6. Requirement to pay jail costs
Super Extreme DUI,  Alcohol Level of .20% or More

Arizona DUI Laws:

  • 28 A.R.S. § 1382.A.2, Super Extreme DUI With BAC of .20% Within 2 Hours

Consequences For First-Time Super Extreme Offenses:

  1. Serve 45 consecutive days in jail
    • If the defendant successfully installs and maintains a certified ignition interlock device in their vehicle with 12 months, 31 days may be taken off
  2. $500 fine including surcharges
  3. DUI assessment fee of $250
  4. State Prison Construction assessment fee of $1,000
  5. State General Fund assessment fee of $1,000
  6. Requirement to pay jail costs

Minimum Sentences for Second-Time Offenses

Unlike first-time offenders, second-time offenders will face heavier consequences and fines than first-time offenses. In addition, a second-time offender will face more jail time and may have to surrender their driver’s license to the court.

  1. Spend 120 consecutive days in jail
